What are the council requirements for Duplexes in NSW?
A duplex is essentially two homes built on the same block of land and which share a common central wall, also known as a dual occupancy. These homes can either share one land title and owner, or can be subdivided into separate titles so they can be owned and sold separately.
A duplex offers many benefits, including the possibility to earn two rental incomes from the one property without the added cost of paying for two separate blocks of land. Duplexes are also attractive options for first-home buyers, those on a modest budget, or those looking for a low-maintenance property as a duplex can be more cost effective to purchase when compared to a detached home similarly located.
Minimum site requirements for a duplex
The Low Rise Housing Diversity Code, which came into effect 1 July 2020, applies to all local government areas in NSW and allows dual occupancies to be approved through the fast-tracked Complying Development process. The new code applies to properties zoned R1, R2, R3 and RU5 across NSW, with designs also required to meet the Low Rise Housing Diversity Design Guide.
Under the new code, blocks must be either 400 square metres or the minimum lot size required by council, whichever is greater. As well, blocks only need to be a minimum of 12 metres wide and buildings must have a minimum side setback of 0.9 metres.
The code requires each dwelling to be a minimum of 5 metres wide, to face a public road, and cannot be located behind another dwelling except on a corner lot. Off-street parking must also be provided for at least one car per dwelling.
